Acceptance of Terms
By using this website or joining the IceCast waitlist, you agree to these Terms of Service. These terms will apply to the IceCast mobile app once it launches as well. If you don't agree with these terms, please don't use IceCast.
You must be at least 13 years of ageto use IceCast or join the waitlist. By using IceCast, you represent that you are 13 or older. If you are under 18, you represent that you have your parent or guardian's permission to use IceCast and that they have read and agreed to these Terms on your behalf.
Description of Service
IceCast provides ice thickness reports and condition information for lakes in Colorado, submitted by a verified reporter network and the broader angler community. IceCast is an information tool intended to help anglers make more informed decisions — it is not a substitute for your own judgment, in-person inspection, or official guidance.
Ice Safety & Assumption of Risk
There is no such thing as 100% safe ice. Ice conditions can change rapidly due to weather, currents, springs, snow cover, and many other factors that no app can fully account for.
- Information shown in IceCast — including ice thickness, condition status (Safe, Caution, Unsafe), and report timestamps — is provided for informational purposes only and comes from third-party reporters. IceCast does not independently verify every report and makes no guarantee of its accuracy, completeness, or current validity.
- By using IceCast, you acknowledge that venturing onto any frozen body of water carries inherent risk, including the risk of serious injury or death, and you assume all such risk voluntarily.
- You agree to always verify ice conditions in person before venturing out, use appropriate safety equipment (such as ice picks and a personal flotation device), and follow guidance from Colorado Parks & Wildlife and other local authorities.
- IceCast, its operators, and its reporters are not liable for any injury, death, property damage, or other loss resulting from your decision to go onto the ice, whether or not based on information from the app.
IceCast informs. You decide. Use your own judgment, and when in doubt, stay off the ice.
Accounts & User Conduct
Once the app launches, you may need an account to submit reports or appear on the leaderboard. You're responsible for the accuracy of any information you submit and for keeping your account credentials secure. You agree not to submit false, misleading, or malicious reports — doing so puts other anglers at risk and may result in removal of your account.
User-Submitted Content
When you submit an ice report, photo, or note, you grant IceCast a non-exclusive, royalty-free license to display that content within the app and associated services (for example, showing your report and reporter rank to other users). You retain ownership of your content.
No Warranty
IceCast is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, reliability, availability, or fitness for a particular purpose.
Limitation of Liability
To the fullest extent permitted by law, IceCast and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of life, injury, or property damage, arising from your use of — or inability to use — IceCast or any information provided through it.
Changes to the Service or Terms
We may update these Terms or change, suspend, or discontinue any part of IceCast at any time. We'll update the effective date above when these Terms change. Continued use of IceCast after changes means you accept the updated Terms.
Dispute Resolution
If you have a dispute with IceCast, we encourage you to contact us first at hello@icecast.app so we can try to resolve it informally. If we cannot resolve the dispute informally, any legal claim arising out of or relating to these Terms or IceCast shall be resolved through binding arbitration in the State of Colorado, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction where necessary to protect intellectual property or confidential information. You waive any right to participate in a class-action lawsuit or class-wide arbitration.
Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law principles.
